THURSDAY, AUGUST 13, 2009

12th Day of the July Term. The Commission Met Pursuant to Adjournment. Present were Presiding Commissioner Albert Fults, Associate Commissioners Garry Nelson and Ray Gettinger and Deputy County Clerk, Cindy Kertz.

THE MEETING WAS CALLED TO ODER BY PRESIDING COMMISSIONER FULTS AT 8:00 A.M.

THE MINUTES OF THE PREVIOUS MEETING WERE READ. A MOTION WAS MADE BY COMMISSIONER NELSON TO APPROVE THE MINUTES AS PRESENTED. COMMISSIONER GETTINGER SECONDED THE MOTION. ALL IN FAVOR. MOTION PASSED.

Commission contacted Joe Fallert, 104th District State Representative, asking him for assistance in retaining the Veteran's Affairs officer for Ste. Genevieve County.

August Roth telephoned Commission regarding the property line survey between Perry and Ste. Genevieve County (Reference Commission Minutes of 2/26/07, 3/31/08) Commission provided him with telephone numbers to the Missouri Department of Natural Resources to discuss the matter with them.

Commission received notice from Michael Hartman with USDA Rural Development, requesting information regarding the RBEG (Rural Business Enterprise Grant) for the Cave Road rehabilitation project. The USDA is asking all grant recipients to report all businesses and verify all jobs created. Commission contacted Hartman and advised that no changes were made and that the Cave Road project assisted only one business (Cave Winery) and a total job count of ten employees, (copy in Cave Road File)

11th Day of the July Term. The Commission Met Pursuant to Adjournment. Present were Presiding Commissioner Albert Fults, Associate Commissioners Garry Nelson and Ray Gettinger and Deputy County Clerk, Cindy Kertz.

THE MEETING WAS CALLED TO ORDER BY PRESIDING COMMISSIONER FULTS AT 8:00 A.M.

THE MINUTES OF THE PREVIOUS MEETING WERE READ. A MOTION WAS MADE BY COMMISSIONER NELSON TO APPROVE THE MINUTES AS PRESENTED. ALL IN FAVOR. MOTON PASSED

Commission receive a letter from Senator Claire McCaskill regarding the Commissions letter of concern pertaining to the Water Restoration Act (reference commission minutes of 5/18/09). McCaskill advised in the letter that this is a highly controversial issue in and around the State of Missouri, stating that she has had responses from many constituents who have strong views on both sides of the issue and that she will consider all the input prior to her making a decision. (copy of letter in commission record supplement) prior to her Commission received a letter from the Missouri Department of Natural Resources (DNR) regarding the FY 2010 District Grant Cycle Financial Assistance Agreement. Commissioner Fults signed the agreement and it was returned to DNR (Copy in commission record supplement).

Commissioner Gettinger, Floodplain Manager, received notification from the State of Missouri Emergency Management Agency, approving the floodplain development permit for the Missouri Department of Transportation, regarding the bridge replacement on Route B over the River Aux Vases River, (copy in commission record supplement) Marion Webery, Road Foreman reported that Burlington Northern R.R. will close Highway 32 near Miller Switch Road for repairs on Thursday, August 13, 2009 7:30 A.M. - 7:30 P.M. Traffic will be re-routed through Miller Switch Road.

THE MINUTES OF THE PREVIOUS MEETING WERE READ. A MOTION WAS MADE BY COMMISSIONER NELSON TO APPROVE THE MINUTES AS PRESENTED. COMMISSIONER FULTS SECONDED THE MOTION. ALL IN FAVOR. MOTION PASSED.

Commission received a Quit Claim Deed dedicating a tract of land for private cemetery purposes known as Roth Cemetery, located on Roth Cemetery Road in Ste. Genevieve County, (copy on file)

Joe Downing, PA Project Specialist with the Federal Emergency Management Agency (FEMA) met with Commission to finalize the paperwork for the storm damage assessment incident period of May 8 through May 16, 2009, Downing provided the Commission with the damage assessment numbers from the U.S. Department of Homeland Security/ Federal Emergency Management Agency (FEMA), advising that the subtotal for damages to county roads and bridges and scope of work from the spring storms and flash flooding amounted to $99,464.50, of which the county will receive 75% reimbursement for these expenses from FEMA. Kathy Waltz, representing Congressman Russ Carnahan's office, met with Commission advising that she contacted the Missouri Veteran's Commission concerning the decision by the State to discontinue having a veterans affairs officer in the Ste, Genevieve County Courthouse office on a monthly basis. Waltz stated that she was advised that they will look into some options. Waltz informed the Commission that In the meantime, she will fill the position temporarily and will be available at the Ste. Genevieve Courthouse location on the third Tuesday of each month.

Commission contacted Ron Weiler with Public Water Supply District regarding areas on Sawmill Road and River Aux Vases Church Road where the water district disturbed the road to make necessary repairs to the water lines. Weiler stated that they will be making the repairs.

9th Day of the July Term. The Commission Met Pursuant to Adjournment. Present were Presiding Commissioner Albert Fults, and Associate Commissioner Garry Nelson-Commissioner Gettinger and Deputy County Clerk, Cindy Kertz absent- vacation.

The Missouri Veterans Affairs officer, Robert Bone, that due to State budget cuts, he will no longer be available at the Ste. Genevieve location (Courthouse) on the third Tuesday of each month. Bone stated that he will have offices in Farmington and Perryville, MO however, the location, date and time is yet to be announced.

Commission contacted Douglas Meyer with the Missouri Veterans Affairs Commission to express the county's concern regarding the matter. Meyer advised that he would check into it further and will be back in touch with the Commission.

Commission also contacted Kathy Waltz with Congressman Carnahan's office to discuss the matter with her.

Commission received a Final Acceptance Report - Off System from the Missouri Department of Transportation regarding the Dry Fork Road bridge over Dry Fork Creek (BRO-095(5). The project consisted of replacing the existing low water crossing with three span concrete deck beam structure, (copy in commission record supplement and on file)
